    What is a "Pay Advice"?

    I filed for Chapter 13 and got assigned a court date of July 2 for the meeting of creditors. I was thinking I filed all the paperwork, but I just received a Notice of Motion from the trustee saying that there is a court date of July 28 and he would motion the court to dismiss for Failure to "provide pay advices" within 15 days of filing my chapter 13 petition.

    Can someone please tell me what is a pay advice? Is it a form I need to fill out? I am self-employed and I don't get any w-2s. What can I show the trustee?

    Can I bring this "pay advice" to the July 2 meeting of creditors and give it to the trustee? Will this prevent the July 28 Motion to Dismiss from happening? Or am I too late?

    A 'Pay Advice' is essentialy your paycheck stub. If you have direct deposit, you will also get in the mail (or at least I did) what looks like a paycheck, but will havee VOID stamped across it. This contains all your usual paystub information such as YTD earnings, witholding for Income tax, medical, worker's comp, etc.

    In your case, being self-employed, I would think that whatever documentation you file with IRS and any paperwork you have gotten back, should suffice.

    If you are self-employed as an 'Independent Contractor' then you would have a 1099 form.

    As to whether you need to amend your paperwork now or can wait until the meeting I'm not sure. There are other members here that can get better advice on that.
