    Cash Gifts, Stimulus Rebate: Include in means test?

    Does a one-time money gift of $750, for a birthday, need to be included in the means test?

    And how about a $1200 stimulus rebate? I looked up many of the recent filings in my district and NOT ONE petition included a stimulus rebate.

    If you are above median, yes, unless the judge in your district has ruled to exclude one-time income on the means test. You can always try, but the UST is attempting to have my case dismissed because of one-time payments like these. In my opinion, if it's something that should count as income on your tax refund, it should be included as income on the means test to be on the safe side.

      Cash gifts, usually yes. Did you deposit this gift into a bank account?


      Stimulus rebates I think are still a gray area on how it applies to the means test, if it does at all (at least in my district). A lawyer in your district could probably best answer that question
