I have a 2nd chance at life. I am now employed after longterm unemployment. I'm a contractor for another month or so then will be employed (tho at 1/3 less than I used to make). I have major debt of approx. $70K with medical bills et al. I'm ready to file papers before Aug. 15. Can I and should I include the state and fed taxes for the contractor fees I already received? I don't have the money to pay the taxes, but I don't want to get audited. I have to guess my net income which will change mid-August when I file, cause I won't get my paycheck till Sept. 7. I used salary.com to figure my deductions. Is that OK, too? If I file by Aug. 15, will I still be considered under the old bankruptcy laws?

My attorney told me last week that you can only bankrupt taxes that met both of the following criteria:
1. Due more than 3 years ago (i.e.: 2001) and.
2. They can't have been assessed in the last 240 days (in other words, if they just caught the fact that you owe back taxes from 2001 and told you about it last month - you'd still have to pay them).
