Unpaid Child Support - How to File?

My ex owed child support but has filed with the court to not have to pay any more, as our son is now 18. However, our son is in school and the divorce agreement says he has to pay. I may or may not ever collect this support money. Do I list it in the Chpt. 7 filing?

You can't file on something you don't have yet and who knows how long it will take for that case to make it through the courts. By the way if it is in the decree he WILL pay. We had issues with child support too but on the other end. My husband's sons all had scholarships so tuition wasnt an issue for us. Consult an attorney; consultation is free.

I am a little unclear what you're asking. Are you filing BK or is your ex-spouse filing BK?

If you are filing BK, you list the back child support as an asset and claim the appropriate exemption.
