    Chapter 7 and Divorce

    Is it common to file for a divorce and Chapter 7 at the same time? I have 60,000 of unsecured debt, in which 36,000 is in my name only and the remainder has my husband listed as the primary and me as co-applicant. I make 45,000 a year, but I can not figure out how I am going to pay my debts and maintain a household for me and my daughter (from a previous marriage). Will I even qualify for a Chapter 7 BK? Help!

    I dont know how common it is but you sure have a lot to deal with afrodite. Sorry about the divorce. You need to consult an attorney to see if you qualify. You make decent money although you will be a single mother. Do you receive child support? A lawyer can sort through the his and hers in respect to the debt so I would post haste seek legal help. I am sure you have heard ad nauseum that the BK law that takes effect in October is going to make it extremely difficult to qualify for a Chapter 7. Good luck.

      Generally, its better to wait until the divorce is finalized before you file BK. But no, its not uncommon that a BK accompany an divorce.

      The reason to wait is to seperate all the property and establish any support obligations. It just makes the BK easier if the divorce is final before you file BK.
