    What if bills are not in your name?

    Debating claiming Bankruptcy, my question is that my wife and I live in my parents extension at the time. We pay rent, but have no proof as this is done in cash. Also my car is in my moms name, I have checks that show I pay on it, and I also have to carry the insurance on it. Can I include these bills for the trustee?
    Or am I better waiting for 6-8 months, leasing a apartment in my name, than filing while in the apartment.

    If the car isn't in your name, then they wouldn't consider that your bill.
    And as for rent, do you have a contract stating you are renting and paying x amount?

      I dont have a receipt for the rent, but if I file in 6 months I can do that.

        You need to start creating a paper trail. STart paying your inlaws with a check. The car likely will be a problem depending on how hardnosed the trustee is. Legally, it's not your obligation but, if you have a history of paying the note from inception, you may catch a break.

        You need to get a few consultations with bk lawyers and see how this is handled in your district. Most will give free or low codt initial consultations.

          I don't know what the laws in your state are, but when I talked to my lawyer, he said that even though my car is in my fiance's name, he can prove that I've been basically "renting" the car to get back and forth to work and justify the payment.
