    What should we do??!!??

    Hi everyone, this is a wonderful site and has provided me with much information!

    Here is my situation and anyone who would like to put their input in would be wonderful and appreciated!

    This is the low down:
    I work as a office medical assistant for $12.60/hr working an average of 32 hours a week, paid biweekly, take home is approx 550.

    My husband works as general labor and makes $16.31/hr working an average of 40-56 hours per week. Honestly, he tries to work 7 days a week and tries to work 3-4 months straight. But unfortunatly, he cannot keep up like this! He is so exhausted and it has really affected our family! Anyhow, based on a 40 hour work week his take home is gross $652.40 net pay is 397.19. He is at 4 deductions and only $26.10 is coming out for 401K. We also have Flex Dependant and Health Care taken out pre-tax at $122.15.

    I did a monthly expense calculator and here is the breakdown:
    (We are a family of 5)

    Mobile Home space Rental: $295
    Mobile Home mortgage (up for sale) $474.02
    Current Home mortagage: $598.00

    We want to give back the mobile home and keep the current home we are in and the van.

    We want to file BK 7.

    We just took out a loan from Citi Financial for $5000.15 on July 17th. It's all gone, paying for vacation, a desperate new furniture purchase and odds and ends.

    We are behind on all of our bills. We will be current on the house and van by mid August. Our mobile home and lot rent are also behind since May.

    Any advice Please????????????????????????????

    Also...

    We have one car that is paid off, a 1998 Husband drives to and from work. We want to keep it.

    We also own 4.5 acres of land that my dad gave me. It was for our doublewide to go on but it didn't appraise out enough to get a loan on. The appraised value was $26,000 free and clear. This is family property and I don't want it to be liquidated. Should I quit-claim the deed back to my dad? We cannot use it now since the doublewide thing won't work. Would it look fishy? We own it free and clear besides the taxes.

        Well, your situation doesn't sound good!!!
        You made a major mistake of borrowing $5,000 in the last 2 weeks to take a vacation, buy some new furniture, and etc. They will demand that is paid back......
        Also if you own and have a deed to the land that is worth $26,000 "free and clear" that is an ASSET!!!
        Trying to "quick deed" it to your dad will not work, trustee can "undo it" and "will"!!!!
        Even though the land is in the "family", if you own it free and clear and your home is not on it........the trustee will more than likely take it to resell!!!
        If your home your keeping is on the land, the trustee normally does not bother it.
        You need to sit down and talk to an attorney as soon as possible about your situation.....especially regarding the land issue.
        If you fortunate you may be able to file Chapter 7(if the land is part of the residence) under the old laws, but if you wait you will be forced into a 13.
