    Should I tell?

    Hey everyone,

    I am getting my paperwork together to file pro se ch. 7 next week Wednesday (this is when I'll have the filing fee). Do you think it's OK for me to tell my creditors this when they call? My phone is ringing off the hook and I just want to tell them so they can stop calling. I know I don't have a case/file number yet so they don't HAVE to stop calling but I figured a couple of them might. I just want to know if I could end up hurting myself somehow by telling them before I acually file.

    Do yourself a "favor" and tell none of them till you get a case number and it has been filed!!
    You don't want anyone take a lien or get a judgement of any kind against you that you will have to go back later and pay to have a avoided.
    A couple of days won't make much difference, just hang up on them, lol.
    Get the papers filed, get your case number, then when they call don't even talk, say "my BK # is filed on date. Do not call here anymore.
    Of course since you are filing yourself - you will have to notify all the creditors yourself according to BK laws.
    Filing yourself can be "tricky" if you case involves a lot! So be carefull.... saving money is great filing yourself - just don't "hurt" yourself in the process trying to save a few bucks...

      What do you mean by this statement.. it's a bit misleading.

        Its my understanding that when you file the clerks office sends notification to the creditors you list in your schedules I believe its the same notice you will get as well . The day you file you will be given a case #. I was lucky I only had one creditor call, Bank of america I gave them the case # and my attorneys address and phone #. She tried to bully me and ask why I was filing, my reply was that my attorney would be glad to answer any questions they had. I wouldnt tell them you are planning to file until you do so. I dont think they would have time in one week to do anything but still why put fuel on the fire.Good luck!!!

          Telling creditors

          I started telling about 4 days before we filed- just to get them to quit calling! They did not have time to respond and it really did help on the number of phone calls. We filed through an attorney so we were very positive that we would file oln a specific day- I would not have said anything if I had not been positive about the filing date.

            Thanks for "waking me up", duh, I must have been asleep again.
            I meant to say - when you file yourself, you have to do all the paperwork, file all motions, etc yourself - so be prepared to do all that - and most people aren't!!! Mostly because they don't know the forms and procedures.
            Your right, the clerk will notify the creditors, you just have to make sure that the clerk has a "complete list" with addresses, etc. for him to go by.
