    The house no longer belongs to us.

    I met with my lawyer 6/26, thought we were going to file, but that is another story. She asked me about the foreclosure auction on 6/10, which never happened. the foreclosure was never in the paper. They changed the locks, we moved out in April. I checked the auction website and it stated "sold back to mortgagee". My lawyer said that it is all over with the house. I am so relieved. Now, we just need to file our chapter 7 at the end of the month.

      Congrats,

      had a question since you just went through this. I have a rental property that is in foreclosure and I was told that the Judgement was Granted on 6/24. What comes after that and what is the usual time frame?

        BD33, it depends on how much the judgement is. They can lien the property and when you sell it, they get their money first. Depends also your equity in the property. They can get a writ of attachment and take your car if it is clear of lien. They can take it anyway but the first lien has to be satisfied when the car is sold. Goes for everything else too. The Judgement is only half the battle, then you have to collect it. It is not always easy to do but depending on the amount they can cause you a bit of trouble. 'Hub

          Question for sick of debt

          We are going to be surrendering our home as well, but I was wondering if you were TOLD the locks were going to be changed? That's scary to me as we haven't fully moved out yet. We just went 90 days on July 1st....so foreclosure is looming!

            No, they did not inform us of the lock change. We found out because the alarm was on and obviously went off when the locksmith was there. When my husband called the mortgage company they stated that they did it because it looked vacant. We actually have not heard a word from the mortgage company in months. Good luck to you.

              Just curious, did you inform them that you were moving out prior to them changing the locks? My place is due to be sold on the 9th and my rental is not available until the 26th so I am considering staying here after the 9th but am kind of freaked about getting locked out.

                Did not tell them we were moving out. they don't even know we are filing ch. 7 the end of the month. I don't think they will lock you out if you are living there. We never actually had the foreclosure auction by their lawyer. The mortgage company bought it back, and now it is all theirs.

                  I was just on the local website for real estate and noticed my house is for sale. Actually, it is not my house anymore. They have it listed for 200,000 less than what we had it on the market for this time last year. It will be a real good score for somebody. Still can't say that I miss it, probably because it caused so many problems.

                    11 months in foreclosure with Countrywide in FL. They are still trying to negotiate with me to save it.

                    I finally called them this week and told them to go change the locks.

                      Sorry to hear Sick , but at least the house problem is resolved . Make sure you list the mortgage lender in the bk or else they can come after you for the deficiency amount .

                        Thank you JR, but I don't want the house. With the homeowner's and flood insurance premiums through the roof, $6000. prop taxes and the $300. monthly association fee, it is so not worth it.

                        House is only upside down by $10,000 and I still don't want it.

                        FL prop taxes and insurance premiums are as high as the northeast. But, at least the northeast has a decent school system, so the tax money is put to good use. Lord knows what FL does with all that money.
