What numbers will the UST use?

I pass the means test by the skin of my teeth but my median income is pretty high so I know the UST will get involved.

My question is, what numbers will he/she use for my utilities and rent since I haven't moved yet? My *current* utilities are low since I'm in a condo and I only live 2 miles from work so gas is low also but my mortgage is high because I have a second. Would it be better to rent an expensive place far from work that has a terrible utility costs?

Of course, I'll be talking with my lawyer again next week but I'm trying to get some idea of what to expect.

    Thanks,
    Stephen

The UST will use the IRS Standards from the DOJ website:

Official website of the U.S. Department of Justice (DOJ). DOJ’s mission is to enforce the law and defend the interests of the United States according to the law; to ensure public safety against threats foreign and domestic; to provide federal leadership in preventing and controlling crime; to seek just punishment for those guilty of unlawful behavior; and to ensure fair and

listed under means testing. If your actual expenses are lower, you can still use them.

So even though my utilities (including HOA which covers my water/garbage) are only $300 I can use the full $419, even if audited and UST wants to change my numbers?

Yes, you can take the full amount on the means. Where you show your actual figures though is on Schedules I & J.
