    Uugghhh!!!

    Ok...this Thursday will be two weeks since I've retained my lawyer. And as ya'll know...I did a LOT of paperwork. I have paid my lawyer in full (HHM). I called today...and they still haven't begun sending out the letters to any of the individuals. I gave them that information on day 2. Speaking with my lawyers wife (she's his paralegal), it looks like by mid Sept she'll have it filed...That doesn't seem right... 2 MONTHS!? I know they are behind because of the flow of individuals rushing to file bankruptcy. I chose this lawyer because he was only 1,000 and other's were charging upwards of 2500 for their services. And at least his price INCLUDES the filing fee.

    Anyhow...I just want to get this going. I've been contemplating for so long to do this...worked on it for the last 4 months...I feel like I should already be expecting my discharge...but it's not even FILED yet!

    Does my situtation sound normal? Am I just getting my panties in a wad? I'm sure I am...

    Guess just afraid, because we are going for a CH 7, because my job is temp and not to exceed 30 Sept. But if we did our 341 meeting after that...I'll make a little more money (if I get picked up by the contract which is a real possibility), however, that might put us into a Ch 13. That would suck cuz then the extra money that I'll make to actually save and do something with, would be disposible income. AARRGGHHH!!

    Mid Septemeber seems pretty long, if you retained the lawyer 2 weeks ago, paid in full, and you have given them all the info they have requested, then there is no reason why they shouldn't be calling your for a final review of your petition in the next week or two and have you filed before mid August.

    Regarding letters, what did your lawyer promise you. The notice of Bankruptcy (that goes to all your creditors) is sent out by the Bankruptcy Court AFTER your bankruptcy petition is filed.

      Just letters to the creditors to inform them that I will be filing bankruptcy...in hopes to stop the calls. She said it was a courtesy that they do. I don't know if this is something that they do on their own...or what. But that I would be receiving copies of what she sends out.

      I thought Mid sept sounded pretty long. When I spoke with her today, she said that she had 20 cases that were pending that she had to get filed next week. She mentioned that they do 4-5 at a time when they file them? I know that he doesn't SOLEY do bankruptcy...he also does other federal trials and stuff. I don't know if that has anything to do with it. I'm just hoping I didn't screw myself here. The money is not refundable, of course, and I was hoping that with 4 months of leg work behind me (created a really nice portfolio for them to get the job done easier), that we would be able to start this process really quick. She's got copies of EVERYTHING down to the most current paycheck stub and living expenses. I'm mean...all that they have to do is get the papers in order...have me sign and file. There is NO leg work at all for them to do. I'm basically paying them to represent me. Had I done it on my own...I'm sure I would've screwed up...but now I'm second thinking that maybe I just should have.

      All that she said was that soon she'll be calling me to verify stuff and that's how I'll know when she's close. I kept pushing that I'd like to have this filed by the end of the month so that we'd have our 341 meeting by the end of Sept. I understand that there are those ahead of me...but if you've got someone who has their crap together...wouldn't you do that one first to get it outta the way? That's what I'd do. It would be quick and simple...then move back onto the ones that have stuff still pending...not in order.

      I dunno...I just hope that I didn't make a mistake. They seemed really nice and not flakey. They did tell me that they are overwhelmed with BK stuff because of the new law. And being a Husband and wife team only...I can understand...to a point. LOL

      Well...I'll give it two more weeks and see where she stands on the 15th I guess....

        I can understand your attorney is busy...they are supposed to be. Most of them are grossly understaffed. The new law doesnt take effect until October. I find it hard to believe too that it will take them until the middle of next month to file? Our attorney had a lot of cases too and I understood clients who were being threatened with foreclosure, etc. took precedence over ours. We met with our lawyer in March; he filed in March. I know you are anxious; I dont wait well either. I would keep putting mild pressure on them to file sooner. Good luck...
