    Should i reaffirm my house

    I filed on 9/19/05 chapter 7.
    I told my lawyer that i wanted to keep house which i still have and have been current the whole time even before BK. I noticed my credit report over the weekend has no history and about a year ago my lender ABN Amro sold it to Citimortgage and they don't report any history either. Citimortgage said i will have to reopen BK case and do a reafframation. I want to build my credit fast as possible and only have a truck that my dad co-signed for me to build my credit. What should I do??

    I have responded to many posts on reaffirmation and I would never reaffirm. You are not legally required to reaffirm a loan. Talk to your attorney about citimortgage saying you have to reaffirm. I think it's bull. If you reaffirm you are setting yourself up for a headache later, a big one.

      Reaffirmation does not guarantee that the lender will report your payments. It would be terrible if you reaffirmed and found this out with your particular lender. You already have a "ride through" that is working, and I wouldn't mess with it if I were you.

        You must sign the reaffirmation prior to discharge.



        (c) An agreement between a holder of a claim and the debtor, the consideration for which, in whole or in part, is based on a debt that is dischargeable in a case under this title is enforceable only to any extent enforceable under applicable nonbankruptcy law, whether or not discharge of such debt is waived, only if--

        (1) such agreement was made before the granting of the discharge under section 727, 1141, 1228, or 1328 of this title;

        The phone jockey at Citi has no idea what they're talking about. Just leave it alone.
        Open a credit card account and pay it off every month. That'll help establish new credit history.

          I know it is purely a personal decision. For us, we are reaffriming our house as we DO NOT want to lose it. We will never be in the predicament we are in right now again. I could care less about payments being reported, I don't want to ever have the feeling of being without our home. Just my opinion, but what do I know.
