    Foreclosure after chapter 7, county took house for taxes

    This is so bad, even our BK lawyer doesn't know what to do. Chapter 7 discharged in 2005, included mortgage. We owed back taxes so the county sold the house at auction. Now mortgage company has filed for a judgement. Can the mortgage company actually get a judgement for a debt that was discharged? I read secured debt cannot be discharged, but the security is the house, which we don't own. Then I supposed there was something in the mortage contract that said we would keep the taxes current so we breached . . . and around and around it goes
    Any help will be greatly appreciated !!!

    When did the tax foreclosure take place and did you reaffirm the mortgage.

      The tax foreclosure took place in December 2004, then the county let the house sit for ~ 1 year before selling it.
      I did not re-affirm.
