    Can one spouse pay on CCs and the other not?

    Hi all,

    If I keep paying on mine but my DH doesn't (he's already two months behind) will his creditors come after the money I've paid on my credit cards?

    We owe on a total of 10 cards and share one of the same banks (BOA), but I also owe on two Citicards and I'm concerned they will come after me if I default since they're suppose to be more aggressive.

    He owes on:
    A bank line of credit (through a union)
    A visa (with the same union)
    BOA
    Capital One

    I owe on:
    Home Depot
    BOA
    CitiCards
    CitiCards another account
    Target Visa
    Washington Mutal

    Thanks for any advice. I'm so paranoid about being sued that I had horrible insomnia last night.

    We CANNOT file for Ch. 7 for one year.

      If I understand your question correctly, you are asking if a creditor like B of A could come after payments you made on your B of A CC account if your husband had an unpaid CC account with them? No, the payments credited to your account aren't going anywhere.

      But... if you're asking if you could be held responsible for your spouse's unpaid credit cards even though they're individual accounts in his name, that depends on where you live. If you are in a community property state, yes, creditors can hold you responsible for the unpaid credit cards even if you had nothing to do with them (or weren't even aware of them).

        What is the point of one of you paying and not the other? Is he filing and you're not? I understand the year wait... are you just trying to avoid a judgement? Just trying to understand

          Oh, sheesh -- I missed this part. I can see your thinking now ..CitiCards are quickly becoming one of my least favorite CC's.

            Whatever you do - close any joint checking/savings accounts that you might have and open your own, preferably at a different bank.

              The goal is for both of us to file in one year, but in the meantime, I hope to avoid judgement on MY cards by paying on them still. . .my fear is that we both will have numerous judgements against us both if we both quit paying for that year.

              We do live in a community property state so that is the reason we'll BOTH file in a year from now.

              Oh, and we have a joint account and then I also have my own account at another bank. Guess I'll put all the money there.

                We live in a community property state too and the first question the my creditors asked me (after I told them I was filing) was if it was a joint filing...

                Just be careful...
                May 2008 Hired 1st Attorney/Stopped paying CCs
                May 21, 2009 Retained 2nd Attorney
                May 28th - Filed for Ch 7 (FINALLY!)
                9/11/09 - DISCHARGED!!!!
