What (if any) type of documentation do they require at the 341 Meeting?

    What (if any) type of documentation do they require at the 341 Meeting?

    I filed about a week and a half ago and expect to hear from my attorney any time and imagine my 341 will be scheduled soon.

    Is it normal to bring any documentation/paperwork like bank statements, paycheck stubs, etc. to this hearing? I want to be properly prepared so it will go as smoothly as possible.

    If you have an attorney, they will probably tell you and different regions and trustees require different things, but generally be prepared to bring the following

    Driver License
    SSN Card
    3 months bank statements, from all accounts (the last statement should cover your DATE OF FILING)
    2 years worth of tax returns, with all schedules, W-2's and 1099's
    3 months of paystubs (also spouse paystubs if applicable)
    Divorce Decree (if divorced in last 2 years)

    The trustee may require less or more, but you should have at least those items ready to go.

      I had my 341 this past Wednesday in Eastern District WI and all I had to bring was myself, my SSN card and my drivers license. I didn't even have to provide all the other stuff to the lawyer. I've never been married so no divorce decree needed, but I only had to show my last 3 paystubs from my weekly unemployment checks and I believe they made photocopies of my last 2 years of tax returns. Surprisingly after I spent considerable time rounding up statements and organizing them they didn't ask to see them. When I sent questions in e-mail before hiring my lawyer I was told 3 years worth of my statements which puzzled me since I only thought I needed 2 years of data. Then when I was there and asked they laughed and said it isn't necessary and if some people brought that many statements for all their bills they'd need to back a dump truck up to the doors. It never hurts to be prepared though and they might ask for different items in your area, especially if the trustee has questions and wants documentation. I brought most of my other paperwork with to my 341 and just left it in the trunk. I figured if he asked then all I had to do was run downstairs and back to my car, but my 341 was relatively painless.

        all i recieved was a letter from the trustee asking for a copy of my last years tax returns and my bank statement

          See, different trustees require different items. All I am saying is be "prepared" to supply the documents I listed, but only supply what the trustee actually asks for.

            HHM, Do they require the same with a ch13?

            HHM, Do they require the same docs with a ch13? My atty's said they don't do as much digging with a 13 as they would for a ch7.I have nothing to hide, and even though you mentioned this before I just feel funny about buying a car and filing 2 1/2 months later since I'm supposed to be bankrupt.

              We provided our lawyer with bank stubs, bank statements, tax returns, receipts and bills. Two weeks before our 341 the U.S. Trustee asked for more bank statements and receipts so it obviously does depend on where you live. I can tell you with absolute certainty in Tennessee they are now asking for bank statements dating back 3 years. I am so glad we didnt wait to file.

                My case was a chapter 7 in eastern district court in SE WI. When I spoke to my lawyer's assistant the week before my 341 about what the trustee was like and how the 341s he told me things are relatively painless here. I told him I heard of some areas like in edwards2's area that are practicing with the new laws already and he said here the exact opposite is occuring. They are going strictly by the current laws in place and not trying to get their feet wet with the new ones. He said due to how much more complicated it will be starting in Oct. they are just trying to move these cases through the system because the amount of filings has been steadily rising the closer to Oct. it gets and aren' being any more demanding than they have in the past. From my 341 and the ones I sat through prior to mine that does seem to be the case. Like stated by the others though, every trustee and area is different. I'd talk to your lawyer and see what they have to say about your specific trustee.
