One last question before my discharge.

Well we just recieved our stimulus check we thought that the trustee was going to take it before we got it. We received a letter before our 341 saying that we had to turn it over....Well to make a long story short the trustee didn't say anything about it at the 341 and afterwards on pacer it is showing that it is a no asset case. I figured that the trustee took it electronically or something. Well the trustee didn't. We just received it. So I called the Trustee to see what was going on. I told the trustee that my bk was about to discharge and I wanted to see if there was anything else that they needed from me. The trustee looked up my bk with my name and searched their notes. After looking for about 20-30 seconds the trustee said that everything looks good and we should get a discharge after the 60 days is up. We only have 2 weeks left

Now I didn't mention the stimulus at all and the trustee did say that everything looked fine for a discharge. If they needed something the trustee would have told me right? So my question is should I call back and be more specific or do you guys think that I am ok?

I personally would rather be safe than sorry and be more specific with them.

hold on to your check...don't say anything. if they need it from you they will send something to you in writing but it would have to be before your discharge so wait for the discharge and if nothing is said. SPEND IT

laurannm I knew someone would say that. So you think that I should just call them and ask if they still need my stimulus? If they know that I have it they will say yes for sure. Dang it man... I am about to lose my job and I really need it.

I verified with the trustee that my case is ok for a dismissal. You don't think that that is good enough? Or do you think they could have overlooked it? There is no mention of my stimulus check on pacer. It just says that I have a no asset case.

Thanks for your responses. And joenjenking that is definately what I want to do for sure. I think that I might just hang on to the check and see what happens.....

I would wait for the case to be dismissed. Don't spend yet, just hold for another 30 days.
          Best of luck.

i woudn't call and say anything. keep the check. if you need it, spend it. worse case senario, they ask for it, you pay them back. i am betting though, that they will not come back and ask for it. why call them up and offer it to them?? i wouldn't. i think sometimes we get a little too freaked out here reading these boards and do things that we really don't have to do. sometimes you can get away with things....
