    Motion for Relief from Stay re: 2005 Acura MDX. Fee Amount $ 150. on behalf of American Honda Finance Corporation. Hearing scheduled for 8/18/2008 at 10:00 AM

    I am planning on giving the car back but should i even go through attanding a court hearing or just call them before have and set up a time to turn it in??

    You do not need to appear at this hearing, unless it's warranted. This is just a formality. You can call the creditor and make arrangements to pick-up the car, or have you drop it off at the dealer. Do you need this car right now, or if it was gone tomorrow, could you still get where you need to go? If so, let it go. Why pay the insurance for it if you don't need it.

      From what I have read, this seems to be a formality they must do before they can repo it. I think I would go ahead and call them and set up a time and place to turn the car in. Take pictures inside and out, and have the person picking it up do a walk around with you, and give you a signed receipt. Then if the hearing doesn't 'melt away', show up with the documentation that you turned it in, in hand.
