    Checking Account Records and such

    Will the Trustee look at my bank account for the last few months and see what we've spent money on?.

    Also Will I have to close my Checking Account after filing bankruptcy? (there are no loans or anything attached to this account).

    Will they question charges on your checking account if not for food and things like that?... Thanks

    How far back will they go? 3 months, 2 months, years??? We went on a vacation in the middle of July and spent a lot on gas, hotel, food, car rental and such.... will that be looked at negatively?

    Normally they check bank statements back 6 months to a year...
    No, you will not have to close out your account unless the bank request it and thats very unusual.

    You said you went on vacation in July and your filing in August??..... Guarantee you Trustee will look into that more than likely....especially if you spent a lot of money and charged it.... Trustee could consider it excessive spending right before filing...

    Let us know what your lawyer says about it....

      Thanks for the quick reply!!!. What kinds of things will they check on the checking account. Nothing on the Vacation was charged (with Credit Card or anything like that) It was all out of our checking account and cash...

        I got the papers from my attorney telling me what to bring to my 341 and all they list is a Social Security Card (or similar document) and Driver's license.

        I'll still package up all my stuff, but thought it was curious that they didn't ask for pay stubs, bank statements, tax papers, etc.

        Luckily for me, my bank statements contain very little by way of activity - so they'll be quick to go through should they need them.

          where do you live annihilus? I live in Southern Denver Metro.

          My Vacation wasn't charged at all, it was paid for with cash and lots of family help.

            My letter stated the same thing and that is all the trustee asked to see was my SSN card and Driver's license while he swore me in. He had my filing in front of him and the only other thing I noticed was the photocopy of my vehicle title that he glanced at when informing me of my rights to reaffirm. It appears that is totally out of the norm though from what others are saying. I'm also curious what area you are in. I'm in SE WI, filed in Eastern District WI court. I also took my paperwork with and just left it in the trunk just in case. It would have been easy to hand over too as it turned out that I parked next to the trustee and he was bringing his box of papers out when I was starting my car. My lawyer barely even asked to see any paperwork which puzzled me since he told me in e-mails I sent before meeting with him to bring it and then it didn't get used. My last 3 paystubs, my title and my taxes were all I remember them really looking at and copying.

            Xar77 - My checking at Chase and my savings at a local CU seem to be unaffected. I had a CC with Chase which was just denied renewal the month before I filed and another which is linked into an overdraft line of credit, but neither had a balance so I think the account is safe.
