    Proof of service by mail

    Just when I thought I was finished with filing my Chapter 7 Bankruptcy, I read in the Nolo book that I am supposed have someone else mail copies of my Statement of Intention to my secured creditors and to the Bankruptcy Trustee. Then, they have to sign a Proof of service by mail, attach it to the original Statement of Intention, then mail it to the Bankruptcy Court.

    I already mailed my Statement of Intention along with the rest of my schedules last Friday. Which they (my local BK court) have received, because it shows in PACER.

    Now what do I do? I have a copy of the original, so I can always make additional copies. Do I have to have someone else do it, or can I do it myself? I don't really want anyone else knowing my personal affairs.

    Are you sure the section you read on that wasn't referring to amendments?

      In the Nolo book "How to File for Chapter 7 Bankruptcy" it says on page 71 (in Chapter 3) under "How to File Your Papers", in step 9, "The bankruptcy rules require you to serve (by mail) the Statement of Intention on each creditor listed on the Statement. Some courts also want you to serve the trustee...."

      Does anyone know anything about this?

        Form 8 is for secured debt, which for many people is minimal to nothing.



        I'm glad that it doesn't include unsecured as well, otherwise I'd have to take out a loan to cover postage.

          LOL @ Postage.. ain't that the truth!

          Ah, yea. I remember now. I did have to serve my mortgage co with a statement of intentions- and a certificate of service. Copies went to the clerk and the trustee. How quickly I forget.. <old timers disease setting in..>

            But can I send it out myself, or do I have to have someone else do it? And what is the Certificate of Service? I just have my car, some jewelry in the pawn shop, and my furniture in storage with the moving company.
