    Selling house after BK discharge?

    Hoping to file chapter 7 soon. Will be filing without my husband. Plan on keeping the house and my car (both purchased by me alone before I got married). After I am discharged, we would like to put the house on the market...at least a year from now. My DH would get our new home loan by himself.

    My question is....we can sell the house right? Any profit (which would be minimal) would be ours right?

    I'm just dreaming of the day when this is over....

    Once you're discharged and closed, you sell anything you like.

      I guess I just can't believe that once this is all over I will actually be able to get on with my life, kwim?

            We wouldn't even put it on the market until next summer but it is nice to think of the future and getting on with my (our) life!

              After discharge, do what you want. BUT, only after.

                Just make sure that you don't reaffirm the house so if things change you can just walk away from it.

                      My attorney recommended that I reafirm on the house and the car. I hear so many different things!

                        Yes, you can sell the house.

                        Generally, there is no reason to reaffirm.

                        Yes, you will get to keep the profit.

                        Note: HOWEVER, you cannot force a short sale of the home after BK. The bank is still entitled to the value of its lien, so even if you do not reaffirm, you still must pay off the FULL amount of the mortgages, (unless the bank accepts less).

                          I want to sell my house i got my discharge and paying six monthly payments for personal property which will be paid in dec in full. Can I sell then?
                          And any advise how to sell a house now with this market I need to go back to new jersey??
