I am assuming that since I have recent (as of yesterday) living expenses and a few cash advances on one card, a 5k bal transfer from May 08 on another, that my lawyer (when I choose him) will tell me to wait at least 90 days. No?

It wouldn't be fraud you would have to pay it back if you don't wait the 60/90 days
fraud comes in it you put something on your card with no intetion to pay but they all so have to prove that.Chapter 7 07/30/2008

Since the advances aren't that old, I would wait the 90 days. If the advances were for a big amount, I would wait longer. If you can't wait, and you need to file you might have to repay the money.
