    Question on exemptions when surrendering a home

    My trustee has apparently decided he wants my car - or wants me to buy it back. He has sent us a letter officially objecting to the exemption. I have two questions here that I would like help with if anyone knows.

    1) I thought I remember seeing that if you are surrendering your home you are entitled to additional exemptions. Is that true? I am in FL if that matters.

    2) If we did agree AND could find a way to scrounge up the approximately $200/month he wants to buy back the car, is that then of this process for us? Or can we expect another monthly payment to settle this case before discharge?

    MikeS, I'm in the same situation. I live in Florida as well, my trustee wants around $3,300and $2,000 of that is from my vehicle. I found out the hard way that I should have put my wife's name on the car title as well as mine.

    1) If you are surrendering your home in Ch7 then you will get around $4,000 worth of exemptions. Double that if your married.

    2) Ill be able to answer after my 341 next week
