    Our 341 meeting tomorrow...

    Well I read here a little bit and only posted a few times. But our 341 meeting is tomorrow. I enjoyed reading others experience in these. It kinda gets you ready for one.

    Today was stressful though. I read people on here saying anything like a bill with your SSN on it would work. And just a few days ago our lawyer called and explained we needed a few things.... huh? A few days and we need to bring stuff?

    I guess I don't read closely in here. He told us that we had to have our SS cards and if we didn't have the actual cards that the guy would make it a continuation. So today... one day before the meeting we rushed to the Social Security branch downtown. It was after my "freelance" computer work so we were probably going to miss closing which was at 4pm. So we get lost in a downtown building where we parked... finally make it to the right building across the street... and only had like 4 mins. to spare lol. They locked up after we came in.

    THEN we had to rush over to KY and get my proof of unemployment. Which our lawyer didn't mention I'd need. Again... that placed closed at 4:30... got in with a few spare minutes lol.

    Get home... then the tire goes flat!!! Luckly we made it home. But it's my friends car that he's letting us borrow... since we are waiting for our Kia to get repo'd. Couldn't get a tire in time since most places closed at 6 or 7 ish. So I guess we'll have to drive the Kia tomorrow.

    Hopefully it won't be too painful tomorrow. Can't wait to get this stuff over with. Well gotta print some invoices out for the meeting tomorrow. Sorry for the babbling.

    ACK, you describe Murphy's Law at it's finest. It sounds like you have the printouts that social security gave you, and I think they would suffice, but it may also be helpful to bring a 1099 or recent (original) W2 or paystub with the number on it. I have never heard that a bill would work but could be wrong.

    My question to you would be, why (as you said you knew a few measly days ago), you would wait until today to do anything? A few days could make a difference and I certainly wouldn't have cut it that close. Yes, I would have stopped everything I was doing if I'd had to.

    Anyway, your lawyer definitely waited too long to tell you what you needed (are you sure he didn't send you something a few weeks ago in the mail explaining all this?).

    In any case, your situation is a perfect illustration that people need to educate themselves and not rely solely on their lawyers for guidance throughout this process. True that they should be able to, but reality is that sometimes the guidance will not be adequate and people need to look out for themselves.

    EDUCATE YOURSELVES EVERYONE.

        Hopefully you got all the bullcrap out of the way! Now you're going to have a quick, smooth sailing 341 meeting!

        June 13, 2008 - 341 Meeting
        August 12, 2008 - Last day for objections... August 18, 2008 - Discharged!
        August 26, 2008 - CASE CLOSED!

            No matter what anyone says how easy it was, going to a 341 is stressful, ten minutes later, "blessed relief". 'Hub

                      Thanks to all...

                      Sorry I'm late in posting an update.

                      First to epiphany:
                      We did get a letter from our lawyer reminding us of the meeting and that he would see us a little bit early on the 341 meeting. He never mentioned needing our house documents(house foreclosed and already sold at auction) or the employment stuff. Oh well.

                      Besides being a few minutes late because we couldn't find the building downtown... basically driving around the block. The meeting went fine. It was easy and no sweat. The only thing concerning me is, we had a lawsuit against me.

                      Basically in Ohio you rear end someone it's automatically your fault. But I hit this lady in the tail end while trying to merge on to the interstate. Instead of merging she was at a complete dead stop waiting to merge. While checking to see if I could get over... wham there she was. So now she wants over 24,000 dollars in damages... any who the lawyer told us we didn't have to worry about the case or anything.

                      The guy at the 341 meeting asked us about the lawsuit and asked if we had insurance at the time. I said yes we did and he gave me a confused look as if why would they be suing you then... and he said to make sure I get that taken care of.... so now I'm like... now we have to worry about this case???

                      Sorry I'm babbling... 341 meeting went great... so now all we need to do is wait!

                        Hi AV: I'm sleepless with you. I am very pleased the 341 went fine. Congratulations!!!

                        On the rear-end bit: it is also the law--or at least practice in Florida--that if you bring up the rear in a collision, it is automatically your fault. It doesn't matter if the person backed into you--which is essentially what your person did by NOT using the acceleration lane for what it was designed for, i.e. accelerate and MERGE with traffic.

                        What does your car insurance representative say? The respective auto insurances are going to have to go at it with each other, is what I am thinking.

                        From what you said in your post, this person sounds like a 'fall-down-con-artist', only in automobile form.

                        If your BK attorney is telling you not to worry about it, please try not to. [FAR easier said than done; I know all too well.]

                          Well shoot, I am glad your 341 went well.

                          I understand the judgment aspect, I have one too, though it is from a creepy crawler creditor.

                          The rear end laws are the same here in California and I swear they are unfair. I often think that is is just a matter of time, here in the land of bonehead drivers, that I rear end someone who stops short to brake for an agile snail because they think it looks like the Virgin Mary and that they can sell it on eBay.

                          I am glad that your 341 went well. I'm confused though, was that traffic judgment included or not in your BK? I sure hope so!

                            You should send the lawsuit paperwork to your insurance. They start off by sueing "you" and you just forward it to your insurance company and they take care of it. We are also being sued for a fender bender and we were told by our lawyer that "technically" if we would have put it in the BK it would have been discharged instead of giving it to our insurance company. Hope this helps.
