    Mess #2.

    Long sotry short we filed chapter 7-- 3 yrs and a few months ago. Yes we got our selves in trouble again. We want to pay it all back, as crazy as that may sound, but we want protection from being sued/garmished while we do it. Can we file chapter 13, pay 100% back and get protection? I don't belive we can get a discharge, but again that is not what we are looking for. I have an appt tomorrow with a lawyer as they would not tell me over the phone. Any information would be appreciated.

    Of what I know and learned here, you cannot file and get anything removed. You can 13 and pay back. However, I like your ‘Nick” but it tells me a lot about you. You must learn, self control. Please, I’m not lecturing. I just experienced and here I am at my age in the same boat. BUT NOT TWICE. You do have this opportunity. I pray you good fortune in your endeavor. ‘Hub

        The timeline for discharge in a chapter 13 from a prior 7 is only 4 years. If I were you, I would try to hold out and file Chapter 13 at the expiration of that 4 year time.

        Thus, if you can wait the additional months to get to the 4 year mark, you can file a normal chapter 13 and receive a discharge of that chapter 13.

          I do understand what your saying however, we want to pay it all back. There are many reasons we feel that way, hard to detail here, but we want to. I did go to see the lawyer today and we can do just that, we will pay 100% back, however we will be protected from futher collection actions. I do have a question however, which I asked the lawyer and he said yes, but I wanted to double check. Not that I want to make anymore bills, however my job is somewhat pressuring me to finish my degree. We do have tution reinbursment, however it won't cover the entire amount needed to finish. I would need to take out some student loan to accomplish this. If not it would take me 8 years to be done. The lawyer said that student loans can be taken out during a 13 with the courts approval and he does that often for people. What do you think? Also what if you need a new car during your payback period? He said its the same deal, but is that true? Thanks Dumbagain
