    Question about time frame, which is correct?

    I've read how many people stated they were required to provide 6 months worth of bank statements, paystubs, etc., when they filed Ch.7. When I met with my attorney, he only asked for 60 days worth of pay stubs, current bank account statements, current credit card statements, 06 & 07 tax returns and I think that was it. Why did he only ask for 60 days worth of stubs and current bank info, instead of 6 months worth?? I hear everyone else talking about 6 months worth of proof and now I'm getting a bit concerned! Does this sound right? Thanks.

    It varies from trustee to trustee. Some trustees want all sorts of info, some not much at all.

    As a requirement of filing (part of the law) you must file 60 days of pay stubs and your most recent tax return. Anything beyond that is up to the trustee. If the UST gets involved, they will probably ask for more documentation as well.

    Using our case as an example, all we provided to our lawyer was 6-months of paystubs (for means test calculations) and 2 years tax returns. Not a single bank statement, no CC statements, nothing else. We are 38 days away from discharge and so far not a peep from anyone.

      My attorney asked for the documents before he even did any paperwork, so how would he know what the Trustee would request when he didn't know who the Trustee would be? I'm guessing he asks all his clients for current statements and 60 days of pay stubs as a general request. I'm guessing if the Trustee and/or the UST wants more info, they'll request it at some point. Thanks.

        I think the lawyers know what their area wants and has worked with each trustee at least once. Hanging in court for a few years would have them knowing each other somewhat IMHO.

        I am sure you will be asked if they need anything else
