    Objections at 341

    What are the chances that creditors will actually show up at the 341? If they do, what is the process that they follow? Do we have to talk to them directly or can our lawyer speak for us?

    341 hearing October 29, 2008.:
    341 went great! Now a member of the 60 day club
    Discharged and closed January 8th, 2009! It is now a Happy New Year!

    If a creditor shows up at your 341, you must answer their questions. The purpose, after all, of the 341 is to allow your creditors an opportunity to question YOU. You are put under oath and must answer the questions yourself.

    Creditors don't file objections, or anything like that at the 341, and no decision is made by the trustee at the 341 vis-a-vis your creditors.

    However, it is quite rare for a creditor so show up at the 341.

      On the day of my 341 there was not one creditor present (I asked around).

        But that doesnt mean that they wont file an objection right? If they do when would they do that before or after the 341? I think they do have a time limit dont they?
        Another question about objections, say you have to let some time pass before you file to make sure theres no objection and you cant make a payment. Made only 4 payments in total and let 8 months pass without paying. Would that suffice? Just curious what anyone thinks even if its a bal trans and a large amount. Do you think they would still persue it?

              If you have debt that is not dischargeable that you are trying to have discharged. You may have used a CC say a month before filing. You may have secured debt like a store CC the creditor maybe consider that a secured debt. Maybe you took a loan and never made a payment on. That can be considered Freud. Chances are your lawyer would tell you if he/she thinks you may have trouble with.
