    Filed Chapter 7: 8/13/08
    341 Meeting: 9/15/08
    Last Day To File Objections: 11/14/08
    Discharged & Closed: 11/18/08

    Explain it the way you did here. #1 was divorce, #2 was problems with mortgage, and that you have learned from these mistakes.

    Filing #1 would have been under Old Law. There have been changes since then, such as the credit counseling courses that are required.

      It would be odd for them to ask you this. Not that it won't happen. It's just that the trustee has about 2 min to talk to you so unless your case is not filed properly or you are hiding something you will probably get the standard questions. I would expect to be asked if you filed before and what was the date. Other than that....I would expect the standard questions.

        I was worried about being asked that question at my 341, especially since I have the big REPEAT flag on my case. I filed ch7 in 1998 ended up filing ch13 almost 10 years to the day later. At my 341 there were a couple of people who were filing for the third time. The trustee asked about the filing, more like he was verifying that they had filed before, but he never asked them why or how they planned to change, etc.

          I think you gave the best answer in your last sentence.

            One of my friends filed twice and on her second 341, he glared at her and asked "Isn't this your second BK?" She said yes. He continued on and all went fine. She said it shamed her and she didn't mind as she wanted to get better with money (her deal).

              He will never ask why you filed.

              He will not ask about future filings.

              He might mention the previous filing, but I'm not sure he would if he does probably only to note whether or not you filed on an allowed date based upon the date of the previous filing.
              May 31st, 2007: Petition Filed by my lawyer
              July 2nd, 2007: 341 Meeting Held
              September 4th, 2007: Discharged and Closed.
