Here's an issue that I can't seam to get any answers on through the forums. Sorry for our long saga of details.
How can my attorney amend my schedules for her fees without my consent? She's done this 3 times.(1x after discharge) (we've paid her 4,600. with 2,400. 00 still due) We signed a 5 page contract agreeing TO AN HOURLY RATE - (stupid of us...savy of her) Oddly enough the court has sent her a Show Cause date to explain these excessive fees. Our case was not difficult, we had assests, there was a verbal & e-mail agreement with the Trustee as to the amount we would pay to keep them, neither our car or home lease were re-affirmed. Our attorney insisted we not close our account and as a result the stay was violated when our mortgage co. took 2 automated payment,( recovered one myself) yet we never filed against them. The attorney fees to do so were 3/4 of the amount we were trying to still recover. We have purposely not proceeded with any of these options to keep her fees down, And as a result we still had a huge bill. Should we appear on her court date, to defend ourselves of these additional due fees? I've wanted to keep our business relationship amicable, especially since we're so close to the end now. Do I need to hire another attorney? I can't pay her remaining fees as it is. She has tried to negoiate with me, for 1,600. in one lump sum. I refused , instead I deducted the amount of the mortgage payment never recovered and counteroffered for 670.00 and ONLY IF she follows through with a letter to the same mortgage co. as to their intentions with the home we discharged (it's been 11 months with no action to move forward with any foreclosure proceedings & I'm concerned there might be another issue we're ot aware of) She's somewhat indicated she'd be agreeable (I think the show cause has something to do with it) but I'm reluctant to pay anymore, thinking maybe the judge will have her return some fees IN A PERFECT WORLD. I've asked her multiple times via e-mail about the show cause date, what it intails, if she would still have to attend if we came to an agreement, & if it was the result of her amending our schedules for her fees again etc. she has continued to evade the questions and it's now been ten days with no response. I 'm thinking of going but want to be prepared, but can't get any answers to my questions from her. Has anyone gone through this before?
