    Need question answered on Ch. 7

    I am seriously considering filing due to an impending collections suit against me that I have no way of paying.

    My question is: my wife and I have two car payments that are current and we would want to keep both cars.

    If I am the sole filer (she's not listed on the account I'm being sued over), would we have to reaffirm the cars or would everything be OK since they're on both our names? We would keep paying monthly payments and everything.

    Not the easiest question to answer ... you can only keep one vehicle in bankruptcy, so I don't believe you can reaffirm both. Here's the catch - if she's the co-signer they would go after her for both payments, ending up that you would both be responsible because you're married. Ask a lawyer about this one or maybe one of the moderators can answer.
