    No Objection Filed?? Normal??

    The deadline for objections to my plan is 9/8/08.

    I know there's still 90 minutes left, but so far nothing has been filed.

    My attorney told me early on there are ALWAYS objections. Is this deadline for real or can the Trustee just ignore it? Or is it for everyone BUT the Trustee?

    I'm just speaking from my personal experience - and every bankruptcy is different.

    That being said - I did not have any objections filed from the creditors. As I understand it - an objection is a question regarding your income, expenses, proposed payback or amount of claim filed with each creditor. And while objections can be common - I know from personal experience that's it's possible not to have any objections filed from your creditors. That doesn't mean they aren't filing claims so they will be paid but just haven't objected to the details of your plan.

    I believe it's much more common for an objection from the trustee (I had one objection) and the trustee objection(s) can be for the same reasons (proposed payment, income, expenses) but probably more commonly the trustee makes objections because of other paperwork or details being left out of the plan or to simply gather additional information - my trustee objected because I hadn't submitted additional documentation for bank statements - but once that information was provided - the objection was immediately removed.

    Really - sounds like your bankruptcy has gotten off to a smooth start! I think the trustee can object at anytime but I think they would have by now if they were going to.

    Again thought, I'm just speaking from personal experience but I think you're golden and have nothing to worry about.

      Correct, creditor objections are rare in 13 and I doubt your attorney was referring to creditor objections. He probably meant that the trustee almost always files an objection (which is basically true). The trustees deadline for filing an objection is the date of the confirmation hearing.

        So I'm not in the clear from the Trustee yet? Darn! I was hoping that 'Last Date for Objections' applied to everyone.

          I Go To Court Tomorrow..............

          this was a trustee objection to my payment plan which didn't get worked out. my lawyer said don't worry. well, i'm worried, it's my azz not my lawyers. i didn't think it would go this far. i'll let you know what happens...........
