On my chapter 13 bankruptcy for my mortgage it has the following:
XX mortgage company claimed amount: $34,598.52
Scheduled amount: $30,300.00
XX mortgage company arrears:
claimed amount: $5326.37
scheduled amount: $5200.00
Is the scheduled amount the actual amount that I have to pay the mortgage company? I noticed on the interest form at the end of the year the mortgage company said payoff was $35,900.....Which according to amorization it should be $30,952.00. (purchased home 11/93 for $39016,8% interest). Also the $5326.37 arrears must be including late fees and attorney fees for the mortgage company. I only owed $4200 in actual payments to them.The attorney for the mortgage company did not file. ...........Also theres "junk debtors" on the chapter 13. EX: 15 years ago I owed target about $400. Assest acceptance filed a claim for target in the amount of $972.00 for a 15 year old debt. Can they do this? Unfortunately I have an attorney who basically is always "out of the office" after I paid her.
