        My attorney doesn't attend 341's. The firm has a specific person for that.

          My attorney did not attend but he did send one. However, I think the guy was freelance because he was representing many other folks, and from hearing him talk to them prior to the 341, he was working for other lawyers besides mine.

          Didn't matter. He knew what he was doing.

          If you are concerned, you need to ask your attorney if there is going to be an attorney there with you at the 341. It is pretty standard practice but I had asked the question to be sure. It was comforting to me to know that.

              It is something you should ask your attorney.

              Mine was there as well as his paralegal.

              Sometimes they have fill ins though so you need to ask them.
              May 31st, 2007: Petition Filed by my lawyer
              July 2nd, 2007: 341 Meeting Held
              September 4th, 2007: Discharged and Closed.

                What I want to know is how often they chime in and do something useful when they are there. The fact that so many of them take the 341 so lightly makes me believe there's no big deal if they attend or not.

                Did anyone ever have their attorney resucue them at their 341 in a way that would have been different without them?
                Discharged November 2008 100 days after filing no-asset Chapter 7. We intended to let a two-year-old vehicle go back to the bank and reaffirm an inexpensive ten-year-old SUV and our home mortgage. In the end we surrendered ALL of our vehicles and reaffirmed NOTHING. We'll "ride through" our mortgage after the court ruled it an undue hardship.

                  The attorney only answered one question or two I think, mostly if he had filled out the paperwork. Then all other questions were directed to me. Mine was a pretty straight forward ch 7 though with no assets or anything.

                    My attorney was there. I would of been a wreck if I had to do that alone.
                    8/5/08 - Filed Chapter 7
                    9/10/08 - 341 Meeting - It went great
                    11/10/08 - Last day for Objections
                    11/12/08 - Discharged & Closed!

                      I knew beforehand that my case was one that could cause a lot of questions but I was ready. So having an attorney there or not, wasn't a big deal to me. He sat there and I did the talking anyway.

                        We had a stand-in at ours. We didn't know who it was until our names were called, and he stood up to accompany us. Frrom talking afterwards it seemed he was familiar with our case, but he said nothing during the 341. We answered all the questions. For the most part they were the standard questions.
