    Pacer question

    I keep seeing people looking/asking about flags but I don't seem to be able to find where these would be listed.

    I found my docket text and it has "Trustee's No Distribution Report: I, the trustee of the estate of the above-named debtor(s), report that I have neither received any property nor paid any money on account of this estate except exempt property; that I have made a diligent inquiry into the financial affairs of the debtor(s) and the location of the property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. No party in interest has filed a request for an order of dismissal pursuant to 11 U.S.C. 521(i)(2). Pursuant to FRBP 5009, I hereby certify that the estate of the above-named debtor(s) has been fully administered. Wherefore, I request that this report be approved, and that I be discharged as trustee. This report is signed and submitted under penalty of perjury. (xxxxxxxxx)"

    Does this mean I'm just waiting for the UST to take a look if they want?

    Also, what is "Order that this case is not subject to dismissal under 521(i)(1).. (dfs, )"

    At least with pacer, I can see WHY I haven't heard from my lawyer. There hasn't been anything filed in the last week.

    Oh, and does the UST look at every case?

    Hi Stephenm:

    No the UST does not look at every case. There is a random audit of every few hundreds of cases, or so. Or if there is some unusual aspect of your case. Yours, to my thinking looks straight-forward and there are no problems and that the trustee is asking to be discharged from yourf case.

    When 'Hub and I look at our case on PACER, we usually go into the History section. In the header will be your name, case number, type of BK, and any flags that might be there. If I am reading your information correctly, I am guessing that you will see something like MEANSNO and ASSETNO. I have learned that MEANSNO means that no presumption of abuse of the BK laws has occurred (I thought it meant you were negative on the Means test! S*I*G*H*) and ASSETNO, means that you are not an asset case.

    You should be good to go and wait out the 60 days that creditors have to file an objection. If that happens, you will see it in PACER. You will also get copies of the paperwork through the US mail.
