    1st and 2nd with same lender and ch7

    We have our 1st and 2nd mortgage with the same bank. We expect to be granted the ch7. If after, we choose to stay in the house, paying the first loan on time and without an affirmation agreement...but not paying at all on the 2nd....what would the consequences be? Would the 2nd loan sit in limbo unitl the house was attempted to be sold at some future date?

    Since the 2nd is considered a 'secured' lien, it would be basically the same principle has a car loan. I think the 2nd lien holder could foreclose on the property, it depends on the foreclosure laws in your state.

      This is for the state of Arizona. So a second Heloc loan can still cause you to be foreclosed on after a discharge, even though you're current with the 1st loan?
