    Creditor filed for Relief of Automatic Stay...

    Hi,

    My husband and I filed for Chapter 7 BK on 9/8. Today, we received a letter in the mail from a law firm representing Wells Fargo Financial. We turned our Trailblazer in on 8/27 to them. Now, they are filling a motion for relief from automatic stay.

    My questions are:

    What exactly does this mean?

    Is this a normal thing for secured creditors to do?

    Why are they saying that we are still in possession of the vehicle when we turned in at the end of August?

    Should I worry about this?

    Thanks, we are freaking out a little!

    341 went great! Now a member of the 60 day club
    Discharged and closed January 8th, 2009! It is now a Happy New Year!

    Hi Folks:

    Quit freaking a little. Evidentally the Wells Fargo didn't get the notice that you turned the vehicle in. They are requesting a lift from the Automatic Stay, so that they can start the repo process. I 've heard of this with homes, not of cars.

    Take your receipt for the turned-in auto, to the bank Monday, and all should be well. If you do not have a receipt, contact the company Monday, and get a dupilcated.

      If you have paperwork, which you should have, take it to the bank or fax to their office.

      The finance for my SUV filed one a a few weeks before my discharged. I had them come get the SUV and I was given paperwork.
