    Had 341 a month ago...UPDATE

    I spoke too soon in my posting a few days ago, about not hearing anything from the Trustee.

    We got a letter today from the trustee stating an objection to our claimed assets on Schedule C (car and other listed assets--which weren't much).

    We are pretty much accepting the fact that we will have to surrender our car. But still don't know when the appraiser is coming.

    I emailed our attorney today...it is nearly impossible to get contact with him by phone with his work week (I am the phone all day, can't really make/take personal calls, especially of this nature). I asked him what this objection really means, and what he can he do for us.

    I really don't like the idea of some stranger rumaging through our stuff. We are not hiding anything, but it feels like I am being violated if someone is going through my underwear drawer.

    Previous posts on here have said that appraisals such as this are not common. Well, I guess we are just so lucky. They have also said that they don't go through all your drawers, etc. Well, I wouldn't put it past them, after what has happened so far. This They are probably looking for all the diamonds and rolex watches. After all, they don't seem to believe us. We live in a 1100 square foot apartment. All of our furniture and most of our child's toys are hand me downs.

    They can take our stuff, fine. I just really wish they wouldn't take my child's toys. It's not much, but she's just a 3 year old little girl.

    I know we have a personal exception in our state, for non vehicles it is $1200 for me and another $1200 for dh.

    I hope our attorney can do something to help us. So far most of what he said would not happen HAS happened.

    Aaaarrrggghhh!!! Footprints. I guess I shoudn't suggest some ideas like putting the cat litter boxes in your drawers, so I won't---

    It really is unusual that a trustee will send someone to yourm home. With all the grief and mess that we have been through, we BEGGED our trustee to come to our house. He didn't.

      I seriously doubt there is any danger of them taking a 3 year olds toys .

      They'll be looking for things that are generally in value 1000 dolalrs or more in a usual audit, something that is worth the Trustees time.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        Appraisals aren't uncommon. There was someone at my 341 that had to get things appraised and his case was continued.
        I would think having an appraisal would be a small price to pay to get your debts discharged.

        The trustee doesn't care about cheap things, they are looking for things they can sell to make money for the creditors. And as long as your Rolex and diamonds can be exempted you are fine.
