Help!!!!

I was chpt 7 discharged on 04/20/2008. It was an asset case with "Order Directing Disbursement of Funds" made on 09/17/2008

The problem is I was long on Wachovia, on margin....so my account is negative 34K. What can I do????

I'd contact your lawyer immediately.

I think Wachovia is being bought out by Citibank this week.

Did the Trustee already take assets for disbursement? If that is the case your bk should complete itself without problem.

However the stock loss if I understand what you are saying is new debt after filing and thus not dischareable .

I think you should contact your lawyer asap and see what you can do.

It is a stock loss that has left me negative on a margin account.

Any chance you could see a rebound, I mean things look bad, the Europeans have nationalized 4 of their banks now.

I don't know how long works and stuff .

No chance, the position has been closed automatically by the brokrage company.

Am I able to add this into the BK?

I don't think so Scooter, since it is after the filing, but take it to your lawyer and ask.

Incidentally did you list this account in the bk petition? I'm not sure why I ask that but maybe your lawyer can find something.

We just got a letter stating that the IRS is making a LATE claim of 5600 and they are allowing it which I'm glad. We owe for 2005 taxes and we can pay it in the plan now as a priority debt but I think that's because the debt was actually incurred before filing...is that right?
