Can anyone please answer a question for me? Can I challenge a creditor a year after the chapter 13 has been confirmed? I have discovered that some bankruptcy debt buyers bought my debt after I filed for Chapter 13. I had questioned my attorney about it when I didn't recognize their names (B-Real LLC, E-Cast Settlement, Round Up Funding), and she got angry with me for questioning her. Anyway, I am in a 100% repayment for 5 years, have paid off my secure and priority debt (IRS, car and lawyer). I do not own a house. Owe $45,000, of which $40,000 is to these debt buyers. I know they have no proof to the claim. I can't stomach the thought of paying these guys all this money when they probably paid 1% of this to buy it, yet my family and I can't afford groceries and utilities let alone a visit to the doctor due to what they take out every paycheck from me. What I am thinking of doing is voluntarily dismissing my Ch 13 and take my chances that they will again sell the debt to someone else. Best case scenario is that since these debts are over 3 years old, there are now bigger fish for them to fry and they'll dump it. I know it will make my credit report worse, but you know what, it is in the toilet already and I do not plan to use credit ever again. I need advice please. Thank you.
