Do they inform you of a motion to dismiss? or do they just dismiss without letting you know it is going to happen? My wife had surgery back in May and we had 3 payments excused and then right after that I lost my job. Now we cannot pay the amount we need to pay. My attorney will not return my calls. To top it all off, I was in a bad car accident last week and cannot even look for work at the moment. I am scared and do not know what to do. I do not want to lose the only car we have left. The car I was driving is totaled and I have an accident attorney for my injuries

This new Chap 13 reform aggravates me to no end.
Bk is supposed to be for relief, not putting people under severe stress for 5 more years.
Maybe they could include in expenses, a forced savings plan and emergency fund to be held in escrow and some "real" financial counseling for people who insist on keeping 3000. mortgage payments, 700. car payments, etc.
