How long should I wait? 2nd post

I am getting worried reading these treads...

I bought my car in Feb 08....still owe a lot

I got a new credit card in January and maxed it out pretty quick

I got a loan about 7k in July...

I lost my second job in August and now I am having problems paying debts.

I met with a second lawyer Friday and he says I should do a Ch7 but I am worried that many of the debts are too new. The car loan is with a credit union where I have other loans and credit cards too. I am really worried and really depressed. I have anxiety attacks all day long at this point and feel like I am drowning. Help!!!

Hi and welcome. Please calm down. Are you keeping the car? Are you current right now with paying your credit cards? When was the last time you charged something? Do you owe a hosue? And, if so are you current with your mortgage payment? About the Loan in July that was when you had a job right? Well, your status has changed, so I wouldn't worry about that. If you attorney said you can file, then you can. I believe the wait time is 90-120 days after you charge something, but i know someone else in here can give you more information on that. I have ALOT of debt and I mean ALOT. close to 300K with everything not counting my 1st mortgage. Have you paid anything on that loan that you took out in July? What was the loan for? I am not being nosey, but if you took a loan to pay someone like a relative or family member that could be a problem. Other then that, you should be fine. Calm down, take a deep breath. Your health is more important then this debt crap. I am a worry wart too! Everything will come together. When does your attorney say to file?

        Ok. Thank you.

I took out the loan in July when I still had my well paying pt job. I lost the job in August. I have paid on that loan since. I took it out at the time to try and pay down debts but it ended up being used to pay taxes, car insurance, payday loans, and things of that nature. I had to since I lost my pt job, I had not other choice. My main job only pays for half the household bills and student loans, car loan.

I requested payment deferments on some of my credit cards, car, and loans to help get me through the next few months. I stopped paying some of the other credit cards in August. I am wondering if there is going to be a problem since I got deferments too!!!

I live with my boyfriend and my boyfriend owns the house. I pay half the bills.

I had the sit down with the lawyer I am going to use friday but I am afraid I did not tell him enough. I guess he can look at the papers when I send him everything. He just looked at the bills I brought but I did not give him the official paperwork or pay him yet

I have a ton of debt also.. Well over $300k in credit cards alone... I have done lots of transfers and lawyer was not concerned with them since I can show where every penny has gone from one creditor to another and no personal cash advances which is usually a problem. As long as you can show a trail of where all your money is going and you have no assets I would not worry about it.

              Inpain,

I can connect with your worry. I want to offer a little perspective. One thing lawyers do is calm the nerves of their clients. Your lawyer will be in your corner. What did your lawyer say about all of this?

Just keep that in the back of your mind: a lawyer can be a source of support. Now, I don't mean he'll be your therapist, but really good lawyers will help you not feel so panicked and/or ashamed. Tell the lawyer everything and let him do some of his work to support you.

              good luck.
