    Providing proof of Income

    I am filing Ch7-no asset.

    My wife cleans her moms house for $65.00 once every 5-6 weeks. We are well below the means so this is not an issue. However, my attorney wants us to provide proof of income. The issue comes into play because sometimes her mother will give us cash, sometimes a check. Also sometimes my in law will give us additional money for our daughters therapist treatments. Additionally, she will just write us a check to pick up some additional things for her and include the cleaning payment in the check with reimbursement for the stuff we picked up. Also, sometimes my wife has cashed the check at the in laws bank sometimes she has deposited it at our bank.

    Our in laws don't know we are filing. They have enough stress with other issues and we don't want to burden them with an issue we have under control . My lawyer said we could just say she gets paid in cash. He's concerned that if we start throwing to many variables the trustee will start digging and asking too many questions.

    Any thought or suggestions on what to provide the attorney as proof of income. We have nothing to hide. We just want to make sure we have everything put together correctly.

    Well, we have the lawyer paid off. Unfortunately we wont be able to pay the filing fee until end of October.

    25 people have read this and no one has an opinion? I know there has to be some self employed people that have went through BK and can suggest how to present payments received. Thanks,

      Hi, You can make a P/L if she is doing this as a side job. I wouldn't count anything the mom paid for directly. Do a little six month profit/loss in excel for gross and expenses (if any).

        PS, I don't think this is a big deal, so no worries. You don't have to tell the mom. And you don't need to account how the monies got translated into accounts. Just May 08 $65 June 08 $65.

          Seriously cash is cash...count it or not..I am self employed and that is about the only perk I have is cash..When I get it I dont count it..just me

            I was kind of thinking along the same lines. This seemed to be the only hiccup so far when dealing with my lawyer. He was trying to tell me something "between the lines".. Unfortunately.. I wasn't reading that well.

            In the end.. I think he was trying tell me come up with a simple statement and don't deviate from it during my 341

              It is so little, why bother? If the lawyer insists write it down as cash on occasion. Remember it is as good as an afidavit, as you are signeing sworn papers. 'Hub

                Yeah, I had a lot of that with my lawyer, read between the lines A simple P/L is the only doc I used. And the meeting, maybe it would go "Did you make blah dollars Mrs MB?" "Yes sir "
