    My father was in CHapter 11 in 1999 and and I am sure never paid back his creditors...He passed away last year but I never thought much about his will (one..it was really sad) but 2 I assumed that the creditors would just gobble it all up..I don't think he has much in his name but if he did should I pursue it since I am his heir. Is there a limitation to when creditors can stop asking for their money? If I went through probate wouldn't the creditors just go for the money?

    OK, may I ask, how many wifes, children are in existance? If he was without will, the next of kin is default. If he had a lot, probate is expected. If he had little don't worry about it. Understand, you are NOT responsible for his debt. Need more info. 'Hub

      You need to find out how his business was legally held, sole prop, corp, etc.
      and if his Chap 11 was completed or dismissed for non payment.

      Did you get a chance to read the will to see how much he left to you?

      Run this by an estate attorney.
