Well today was the day we have been hoping would come. Discharge day. With over 200k in CC's and a line of credit, combined with a totally upside down HELOC of 135k we are done. We also feel extremly lucky and blessed. We are in good shape. We have two good paying jobs, two paid for cars, well funded 401(k)'s, yes even after what has happened this week as well as a nice modest pile of cash in the bank. We are still in our home that we haven't made a payment on since March so we are looking at probably another 5 months before we have to leave at the earliest. Living rent free is kinda fun after what we went through the past two years. Countrywide hasn't done anything yet. That will probably change soon now that we have our discharge. Also found out today that my son in the Army is not going to be deployed until at least July. We thought it was going to be much sooner. We have much to be thankful for. Good luck to all.

How do you get to live rent free? I am thinking about including my mortgage in the BK. Will I be able to stay here for a long time if I do? That would help tremendously if I could go for a long time and save up money for a car and a new place to live.

Our mortgage company (Countrywide) has of this date not taken any foreclosure action against us even though we haven't made a mortgage payment since March. Once they get around to it in Southern California they must first file a Notice of Default. Once that happens you have between 4 and 5 months before the process is complete and you have to leave. That is assuming that everything proceeds in a timely manner. So until all of that happens we are and will continure to live rent free. All we are paying are utilities and insurance on the house. Well the house is still in our name. Now that we have our discharge if they paid the insurance they could bill us for it.
