    Clarification concerning number of persons in household & filing by one's self

    Hello everyone. Yesterday was my first post back here in the forum, as I've been in Galveston helping with hurricane relief.

    May I please ask for some clarification about filing and the means test?

    If there are, for example, 2 persons in the household, but only one will be filing for bankruptcy, the income for 2 persons in the household regarding the means test is still the one used, is that not correct?

    In my situation, I was the only one filing, but they still took my fiance into account. So I'm filing with a household of two.

        Hi BankruptPinoy: Thanks so much for helping in Galveston. 'Hub and I hope to get there later this year.

        On your question, I've read elsewhere here that, though the other person's income wouldn't be counted, that person's financial contribution to running the household is.

            My understanding is that you take in effect what you pay. For example, my rent is $1700/month however I live with two others and only pay $535. That goes the same with utilities and etc...

            So for me, I will be filing under a household of one and will only be including what my actual expenses are and only my income; not the entire household.

              The total people in your household is you plus your spouse plus the number of you and your wives children under the age of 21. You are allowed to count children who don't live with you provided you, or your wife, are paying support.
