    Chapter 7 BK and student loans

    When we filed for BK, we were told that student loans could not be discharged. However, since it was a debt that we owed it had to be listed. When I checked our credit report since we filed, it said it was included in the BK. My loan was in forbearance until the end of September. I couldn't pay the amount that they wanted, so I requested a income sensitive plan. I have never heard back from them and I requested this over 3 weeks ago. So, I am wondering if the student loan company thinks that I may get them discharged in the BK and that is the reason that they are not responding???

    Any insight from anyone? Thanks!

    341 went great! Now a member of the 60 day club
    Discharged and closed January 8th, 2009! It is now a Happy New Year!

    I doubt it. They will probably force you to make payments again after discharge. AND they will probably have you make up the payments you missed while in the bankruptcy process. I would continue to make payments on a monthly basis.

      The burden is on the debtor to prove that student loans gets discharged, so don't assume the lender thinks they are discharged.
