Report of no distribution & Tax Refunds

We are only a few days away from discharge, and about a week after our 341 our trustee filed the standard Trustee's Report of No Distribution.

At our 341 he made a note of what we expected for a tax refund NEXT year. Since he filed his NDR report, is it safe to assume he will not be interested in his portion of the refund next year?

    Thanks!

Would seem so - BUT it could change if there are provisions in the bailout bill that would change that. Remember the bailout bill bails out banks, not the consumer. The 2005 bankruptcy bill was the first bank bailout bill which screwed the consumer.

If the Trustee did not request you to send your refund to him at the 341 meetings and before discharge, then your refund will be yours to keep. Depending on the amount of the refund is what the Trustee bases whether he want it or not.

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
