Chapter 7 Want To Reopen Case

After filing capter 7 bk I was told as a authorized user of credit cards you are not liable for payments,the trustee now is sueing my brother and sister in a adversary proceeding saying they we given prefered treatment and trying to sue them for money they gave me 1 year prior to filing on some intrest on ownership on a house we owned.My question is even if they collect money from them there is nobody to pay if I can reopen my case after its been discharged and closed,is there a way to get this done?thank-you

Ahhh...this is how a trustee gets their paycheck. Trustee's are only paid if they can collect.

I guess I'm confused, Can you try to explain this a little plainer? Maybe I'm dense but I'm not seeing how the authorized users and the house connect.

I didn't make that connection either. I am only commenting on the trustee making their money. They do whatever they want to get some. Just because you may have a discharge does not mean that the case is closed.

Some say that as of the date of "discharge" the debtor is done. Not true, we have had trustees keep cases open for months afterwards, continuing to request more information and attempt to collect $$ from the debtor. We had a new client call yesterday that filed Ch 7 four years ago and received a discharge. His case is still in "open" status on pacer. Trustees can keep them open until they feel satisfied.

Can anybody tell me if I can cancell my chapter 7 bankrupcy filing after a diccharge,I decided I will owe more money after the trustee filed a adversary proceeding than I would if I just worked with my creditors.Help

How is that possible?? Anyway, you are discharged, you cannot "cancel" your Ch 7.

You cannot voluntarily dismiss a Chapter 7. About the only way to is not to show up to the 341 meeting, but since your discharged its to late.

Incidentally you wouldn't owe the money whoever the Trustee is suing would owe it.....

I am guessing that the debtor must have paid a reasonably substantial sum to his relatives to pay back his use of the card as an AU and the trustee figured it out. But, as I posted in your other thread, you cannot revoke a discharged chapter 7. There is a difference between discharge and closing.
