    Brown lawn means jail time

    On Friday morning, Joseph Prudente put on a pair of shorts and his "Grandpa Gone Wild" T-shirt. He took off his wedding band and put his heart medication in a plastic Wal-Mart bag.

    Then his daughter drove him to jail. Grandpa had time to do.

    His crime? He had disobeyed a court order that he sod the lawn at his Beacon Woods home.

    His bail? Zero.

    Prudente, 66, must stay in the Pasco County jail in Land O'Lakes until the required sod work is completed, under a September court order signed by Circuit Judge W. Lowell Bray.

    "He's in prison for God knows how long because we can't afford to sod the lawn," said his sobbing daughter, Jennifer Lehr.

    Prudente has owned a home in the deed restricted community since 1998. The covenants require homeowners to keep their lawns covered with grass.

    Earlier this year, the Beacon Woods Civic Association took Prudente to court after he failed to install new sod on his browning lawn, which had withered after his sprinklers broke. The association had already sent letters telling him to resod his front and back yards by certain dates.

    In an interview at the jail Friday evening, Prudente said he thought he had made a good financial hardship case to the association: His adjustable rate mortgage went up an extra $600 a month. Wachovia repossessed his Toyota Scion. His daughter and her two young children, who had fallen on hard times, moved in with him and his wife, Pat.

    "To me, keeping the house is more important than the grass," said Prudente, a retired registered nurse from New York. "I just ignored them."

    He ignored them, too, after the association filed a complaint in court. He ignored a court order in May, signed by Bray, giving Prudente 30 days to sod the yard.

    In June, the court also awarded the association $795 in fees, which included a $645 attorney's fees and a $150 fee for "an expert witness."

    By September, there was still no sod. Bray found Prudente in contempt of court, but said in his order that Prudente could "purge himself of this contempt" by doing the required work within the next 30 days. That time expired Friday.

    "It is clear to the Court that the ability to avoid incarceration is well within the Defendant's grasp," Bray wrote.

    Representatives of the Beacon Woods association expressed regret Prudente had landed in jail. But they said it was his own fault.

    "It's a sad situation," said board president Bob Ryan, who added that the association had followed all the correct procedures. "But in the end, I have to say he brought it upon himself."

    Lawyer Thomas Gurran, who represents the association, said in a statement that the association had "just wanted Mr. Prudente to comply with the lawn restriction." He added that the contempt power of judges is essential to the system.

    "Many orders and judgements … would be absolutely meaningless if they could not be enforced by a judge's contempt power," he said. "This case is an example of what happens when someone defies an order entered by a judge in our country."

    Prudente's family said the case had gone too far. Pat Prudente said she and her husband knew they had chosen to live in a community with restrictions. "But they shouldn't have this much power," she said.

    Back at the jail — where the population is 1,132, well above the 782 capacity — Parente said he was being treated well. He has no criminal record in Florida and said his stay in Land O'Lakes was his first time ever in a slammer.

    What comes next? He doesn't know. "Should I go out and rob a bank? Then I'd be back here," he said. "But then I'd get out on bail."

      Listen, I am not in a co-op but in 2004, three hurricanes came through and wet our house big time. We are fortunate to have a farm with an outbuilding we are now living in. I was 60 then and I built two houses but at that time I got cancer. I am now 64 and have to repair damage that has now cost us a rotten house I am rebuilding. Fun, to me it is as I can do it, expensive, yes. If I pulled a permit, we would be put off our own land the family owned since 1860. NOBODY OWNS ANYTHING, now in this Country. You rent it by the GUN. Stop paying land tax and in three years or so, the Sheriff will put you off your own land.

      Now, take a look at what is about to happen. OBAAMA, is endorsed by most Muslim countries as well as Putin in Russia. He is for raising every tax possible just to make it FAIR. Fair to whom?

      The best thing that could happen to this Country, is this up coming second Great Depression. Perhaps, then, the evil will be revealed. Even B. Clinton is blaming the Dems or Liberals. Albeit, he is one and guilty too.

        Sounds like this guy wanted some peace and quiet. His daughter and her two young children moved back into an empty nest. I guess jail sounded more inviting. If the sod has to be installed before he is released from jail, it will be interesting to see how much his family wants him home.

            Free from jail, Joseph Prudente, 66, inspects his new lawn with pride Sunday. Prudente, who says he barely has enough to pay the mortgage, was jailed for having a brown lawn.

            BAYONET POINT — Andy Law was eating breakfast with his girlfriend, Mary Dinan, at their Hudson home Saturday morning when she pushed the newspaper at him.

            "Read this," she said.

            It was a story in the St. Petersburg Times about a 66-year-old grandfather, Joseph Prudente, who was jailed without bail on Friday because his lawn was brown. For nearly a year, he ignored letters from his Beacon Woods homeowners' association and a court order because, he said, he barely had the money to pay his mortgage. He was trying to keep his house and didn't care about the lawn.

            "This is not right," Law said. He was livid.

            Law's own handyman business had slowed to nothing, and both he and Dinan lost money when they sold their houses to buy this, their dream home on 5 acres, which they likely will lose. Both are considering bankruptcy.

            Law is a Marine and a problem solver. He is not used to feeling helpless.

            But, he thought, he could fix this for Mr. Prudente.

            "I'm going to do something," Law told his girlfriend.

            "What can you do?" she said.

            "I'm going to help," he said, and was out the door.

            Pat Prudente was in her bedroom when she heard a knock at the door. "Go away," she thought.

            She was in a black daze, thinking of her husband. They've been married for 23 years and met while both worked at a hospital in New York.

            Pat is fiery and Joseph is calm. Even as he left for jail, clutching a grocery bag full of medicine, he tried to joke and make her feel better.

            The two moved into their four-bedroom Beacon Woods home 10 years ago and they live off his pension.

            The knock was insistent.

            "Fine," Pat thought, and got up.

            It was Law, who found their address in an old phone book. He told her they were going to get her husband home and started calling everyone he knew to come help.

            He got a guy to let him borrow a machine to remove the old grass. Two companies donated sod. Soon, the yard was full of people. Pasco County Commissioner Jack Mariano also read the story, found the house, canceled a speech and went to work.

            "I've never seen someone so important get dirty," said Jennifer Lehr, 32, who is Pat's daughter and calls Joseph her dad. Lehr, her husband and their two young daughters moved into the house two years ago after barely scraping by on their own.

            Jennifer and Pat kept trying to feed the strangers working on their lawn, but they kept saying no, to not spend their money.

            A man came to fix the sprinkler. People dropped off checks. A neighbor looked at all the work being done and cried because she felt her faith in humanity restored.

            By 6 that evening, the yard was done. There were blocks of new grass, red mulch, flowers and a working sprinkler.

            A few minutes after everyone left, there was a sudden, thick downpour. Jennifer stood in it, feeling the rain, arms wide. And when it stopped, there was a rainbow stretching over the house.

            She looked up and thought, "Our luck is changing."

            Joseph Prudente had a court hearing Sunday morning, arranged by Mariano, Pasco Sheriff Bob White and others. After hearing testimony from a Beacon Woods Civic Association representative that the work had been done, Circuit Judge W. Lowell Bray said Joseph Prudente could be released, though he still faces court and association fines.

            When Pat Prudente drove up to the jail at noon, her husband was already out and waiting on a bench. She flew out of the car and kissed him. He said he had been treated fine. The guards were nice to him. And then he asked his wife if it was okay if they dropped off another inmate, a woman who also had just been released, at her home because she didn't have a ride. She said "of course."

            The rest of the family waited at the house, along with Mariano and his wife and children, and Law and his girlfriend.

            Joseph Prudente didn't know about the work that had been done at his home, about the strangers who came together to help him.

            And when he pulled in the driveway and stepped out of his car, he cried.

            "Welcome home," Law said, and shook his hand.

                    A Pasco County man's community has pulled together to help him out.

                    Joseph Prudente, 66, got a $1,000 fine from the Beacon Woods Civic Association in Hudson after he didn't replace the brown sod in his yard.

                    Prudente said he didn't do it because he had to pay his home mortgage, which was two months behind.

                    But when he didn't show up for a court date over the brown yard, a judge found him in contempt of court. Prudente had to report to jail and he did it wearing his "Grandpa Gone Wild shirt."

                    "The other residents (inmates), they didn't believe it when I says, 'Why you in here?', I says 'grass'," Prudente said. "They say, 'You mean' (gesture)? I said 'No, grass on the ground.'"

                    He spent two nights in jail, which outraged Andy Law, who saw the story in the newspaper.

                    "I personally thought it was wrong. It's wrong to put our senior citizens in jail for a brown lawn," he said.

                    Law rallied 15-20 people from the community, including a city council member. They worked all day to put Prudente's yard together.

                    "You get a bunch of guys and it's like putting a puzzle together," Law said.

                    They got donated sod, a sprinkler and the yard was green again.

                    So, the judge released Prudente.

                    Now, the HOA president is getting hate e-mail from across the world.

                    "We are not as we we're called in some of e-mail 'a pack of Nazis', we're not power hungry people," said HOA president Bob Ryan. "We are simply fellow homeowners of Mr. Prudente, I felt sorry for him."

                    But he says Prudente didn't follow the rules and the HOA was just following rules that apply with Florida statue's for homeowner associations.

                    "Bob" says he felt sorry for Mr. Prudente, then why not work as neighbours and help? Did "Bob" get dirty laying sod?

                    But now the HOA led by "Mister" Bob Ryan may fine Mr. Prudente and his wife for the large sign welcoming him home from jail?????

                    Andy Law is on the verge of bankruptcy himself and he is not from the "community" of fine people like Bob Ryan. Instead the fine people of the HOA community want to supposedly just follow the rules and protect their property values...

                      Amazing story.
                      This is why many foreigners hate americans--this is their idea ,the HOA, of what wasteful americans are like--In the most distressing of times--some HOA is more worried about the color of a lawn.
                      It truly disgusts me that people DID NOT become involved BEFORE this man went to jail--really, this PROVES what the neighbors are like in one of these types of restricted communities...Selfish, self centered, down right ornary, & disconneted people IMHO. They SHOULD BE ASHAMED OF THEMSELVES.
                      Just the word "community" in this case is an OXYMORON--Someone from the outside came in and took charge and got something done--Not someone from their "community". The neighbors could not have cared less--they did nothing, except make sure they filed complaints to the HOA...
                      Is there a church in this "community"??? Instead of the neighbors filing complaints 1st--why not approach the church and see if someone was in trouble and needed help??? Why not??? Because these people do not want to be part of a "community"--that would mean getting involved and helping one another.
                      I sure am glad I don't live there.

                          When I read the first post (like 10 minutes ago) I was going to ask if there was anywhere we could get an address for this poor man do send donations. I don't have much, but I know that every little bit helps. I am glad that someone felt the urge to help, but I am disgusted that this was brought upon him by his so called neighbors. What is wrong with people?

                            I pay two HOA's. Yes, they are frikking Nazi's. Retired and power hungry. The one I pay is the main one, run by working class, they are a bit to lenient. The other for the entire area which includes several HOA's is a pain. My neighbor told the nosy bastard enforcement guy that he might get shot opening his gate the next time. We own the land in these TH's and the guy is not supposed to walk around the property but does. They are a pain.

                            Where the hell do they get off with these names? Beacon Woods, where are the woods and Beacons? Silver Lakes? Where are the frigging lakes and are they silver? We have all these developments in SoFla with all these fancy names and inside the walls of half they outta' be called "Tiny Sh*thole Tenth Acres" instead of "The Estates of Rolling Hills" or "The Bog" instead of "The Landings" especially after the first rain. I mean we are "Southpointe" and mark the "pointE" not point. You will find us just behind the Shell Gas Station and the BP/Amoco with the McDonalds which is beside "Sandpiper Cove Estates" which have no Sandpipers, Coves and are on 75x100 lots.

                            My mother has to deal with these retired Nazi's in Sunrise lakes, one community, 40,000 residents and an automatic dislike of anyone Spanish. She went through hell to get in, they went way into her personal finances, but it was the only affordable place (all over 55 so the condos are cheap).

                              Ahh the joys of capitalism and free choice.

                              Here in beautiful NW Arkansas where I have chosento live, we don't have nasty things like HoA's (except for one retirement area but they are incorporating into a real city).

                              I hate to be the devils advocate, but if you don't like dealing with a HoA, start working out a plan to move to an area that doesn't have one. It's kinda like when folks complain about their job...so start looking for a different one!
