    Question on CH 13

    I may be having to go to a CH 13 after the lawyer had told me all along that I would be a 7, so after freaking out a bit about it I have a serious question about it. If I am current on everything, how do you decide what goes into the plan and what gets paid outside it? Also, if I start this plan in December or January and my gf comes home in June and will be splitting all my expenses including the mortgage with me. How does that get overseen? Technically I will still show I make around the same, am I free and clear at that point. Do they order statements of your checking accounts or do you just give them a w-2?

    Also, if I am forced into CH 13, doesn't it make sense if I'm going to be in it for 5 years to buy a new car right before? If I file ch 13 there's nothing they can do for me at that point, correct?

      If you have to file 13, you repayment plan will be based on your income for the past 6 months. If your GF was living with you now, her income may have to be considered. Since she's not, I wouldn't mention it. If she does move in with you 6 months after you are confirmed, then good for you. Just don't get married before you're finished.

        Yes, it is often recommended to purchase a new (or good used) vehicle to last through your 3-5 year plan.
