Hi all,I'm separated with 2 small children, homeowner with $15k HELOC, car and about $30k in unsecured debt. Since hubby left us almost 2 yrs ago, it's been a tough financial road, especially with 2 in day care. In early Sept., I thought about bk, thinking that I would only be eligible for Ch. 13 because of my salary of $66k, house pmt of $755, and nearly paid-for auto. To my surprise, I passed the means test and was eligible for Ch. 7 no asset. Yayyyy! The collectors were calling from 8am to 9pm and started sending nasty letters and being so rude. My nerves were getting bad. Was struggling, going in the hole each month to the tune of about $700 including overdraft fees.
I've been lurking on this board and decided to file Ch. 7 on 9/17. Thanks to my company's legal plan, all but $300 was covered. I'm in Georgia and had my 341 yesterday. Checked PACER today and found that the trustee has signed off and now I begin th 60-day wait. The first 10 cases went quick...about 5 minutes each. Cases started to run about 1 hour behind because the Trustee grilled two people for about 25 minutes each. In both cases, the attys just seemed useless -- the info on the trustee's paperwork differed from what the filers said..."your paperwork lists 3 dependents...you just told me 2 dependents". Luckily, my atty had all ducks in a row. The Trustee did question the value of my home and whether there was equity. I got a little nervous, but atty said not to worry. Oh, and Dell made an auto-debit from my acct on 10/17 so I called last Friday to cancel auto-debit. To my surprise, atty showed me a settlement offer he received that very day from Dell. I owed them $2400, and they offered settlement of $600 @ $20/month. I have a fairly new laptop, desktop and two digital cameras from them. Atty said they might come after equipment if I did not settle. That's fine!Discharged scheduled for 12/26/08. Merry Christmas to me!
